Terms of use.

1. Scope

These terms apply to the use of samobor-guide.com (Samobor Guide) and to all contracts for listings and packages between Design Planet, Inh. Simon Mast, Tulpenweg 4, 8107 Buchs ZH, Switzerland (“we”, “us”) and businesses or their representatives (“you”). By using the website or buying a package, you accept these terms.

Packages are intended for businesses. If you buy a package, you confirm that you are authorised to act for the business.

2. Our service

Samobor Guide is a travel guide and business directory for Samobor and Sveta Nedelja. Using the website is free of charge for visitors.

Basic listings come from open data and are not checked by us or by the business unless the business has claimed them. We do not guarantee that listings and guide articles are correct, complete or up to date. There is no entitlement to a listing, to a particular position in lists or to a particular number of visitors, calls or enquiries.

We may change, extend or discontinue features of the website. The website is available as far as technically possible; we do not guarantee uninterrupted availability.

3. Claiming, adding and deleting listings

Owners and authorised representatives can claim the listing of their business or add a missing business free of charge. Before we publish a claim or a new listing, we may ask for proof that you are entitled to act for the business, for example by calling the phone number of the business. We may refuse a claim or a listing if this is unclear.

Businesses can ask us to correct or delete their listing at any time, free of charge, by writing to info@samobor-guide.com.

4. Your obligations and your content

You provide correct and current information and tell us about changes. You may only send us texts, photos, logos and links for which you hold the necessary rights and which do not infringe the rights of others or the law.

Posts under “Latest news” must be factual and relate to your business. We check every post and every text before it is published and may refuse or remove it.

You allow us, free of charge and non-exclusively, to publish and store your content on the website, to adapt it for display (for example the image size) and to translate it into English or Croatian, for as long as your listing is shown.

5. Refusal and removal by us

We may refuse, change or remove listings, content and Featured listings that are wrong or misleading, infringe rights, are unlawful or do not fit the purpose of the guide. If we remove paid content because of a breach of these terms, there is no entitlement to a refund.

6. Packages

Basic is free of charge for every business in Samobor and Sveta Nedelja. Featured adds, among other things, your own description, up to 10 photos, opening hours, links to your website and social media, the “Featured” badge and short posts under “Latest news”. The current content and prices of the packages are shown on the page Packages.

Featured is paid advertising and is always labelled “Featured”. We do not guarantee a particular number of views, clicks, calls or enquiries.

7. Prices, payment and activation

All prices are in euro and include any applicable statutory value added tax (VAT). Design Planet is currently not entered in the Swiss VAT register; no VAT is shown.

Once you have claimed your listing and we have agreed on a package with you, we send you a personal payment link by e-mail. The contract for the package is concluded when you complete the payment on the payment page and we confirm it by e-mail. Payment is made once and in advance, in euro, via our payment provider Stripe, with the payment methods shown on the payment page (for example card, Apple Pay or Google Pay). You enter your payment details directly with Stripe; we do not receive them. Your bank or card issuer may charge fees, for example for currency conversion.

We activate Featured after the payment has been confirmed. Changes become visible with the next update of the website. The confirmation e-mail serves as your receipt.

8. Term and expiry

Featured runs for one year from the day the payment is confirmed. It does not renew automatically; there is no subscription. If you pay again before the end of the term, the new year starts on the previous expiry date. After expiry, the listing returns to Basic.

9. Refunds

On request, we refund the full price if you ask for it within 14 days of the payment, unless we have removed or restricted the listing because of a breach of these terms. The refund is made in the amount paid, to the original payment method. Featured then ends and the listing returns to Basic.

After 14 days there is no entitlement to a refund, including if you have your listing deleted before the end of the term. Mandatory statutory rights remain reserved. If we discontinue Samobor Guide before the end of a paid term, we refund the unused part of the price pro rata.

10. Liability

We are liable only for intent and gross negligence, to the extent permitted by law. In particular, we are not liable for the correctness of listings and guide information, for the services of listed businesses, for the content of linked websites or for interruptions of the website. Mandatory statutory liability remains reserved.

11. Data protection

Our privacy policy applies. Payments are processed by Stripe under its own privacy policy (stripe.com/privacy (opens in a new window)).

12. Changes to these terms

We may change these terms; the current version is published on this page. For a Featured listing that has already been paid, changes take effect 30 days after we have informed you by e-mail. Changes never affect the price or the scope of a package already paid to your disadvantage.

13. Language

These terms are published in English and Croatian. If the two versions differ, the English version prevails.

14. Applicable law and place of jurisdiction

These terms and all contracts under them are governed by Swiss law, excluding its conflict-of-law rules. The place of jurisdiction is the Canton of Zurich, Switzerland. Mandatory places of jurisdiction remain reserved. If any provision is invalid, the remaining provisions remain valid.
